The Parsi Marriage and Divorce Act, 1936


Section 32 of The Parsi Marriage and Divorce Act, 1936, contains 10 fault grounds on which either husband / wife my seek divorce.

  1. Marriage not consumatted within one year owing to the willful refusal of the defendant
  2. Defendant at the time of marriage was of unsound mind and continued
  3. Defendant already pregnant before marriage by other person than the plaintif
  4. Adultry, (dd) Cruelty
  5. Defendant voluntarily caused grievous hurt
  6. Defendant undergoing sentence of 7 years imprisonment or more
  7. Defendant Deserted for past 2 years
  8. Order passed by a Magistrate against the defendant for separate maintenance to the plaintiff, and parties have not had martial intersoure for one year or more since such decree / order
  9. Defendant ceased to be a Parsi
